Bombay HC Halts Allotment of 80 Transit Flats by MHADA

In a setback for over 35 former Bombay Dyeing Mill workers, the Bombay High Court has stayed the allotment of 80 transit tenements in a MHADA redevelopment project on the mill's land in Prabhadevi and Wadala areas.

The workers petitioned the court, alleging irregularities and illegalities, including "double allotments" of flats. The petition highlighted that, under the terms of a 2014 agreement, 5,136 flats were reserved for mill workers. However, the workers claimed that MHADA had constructed six buildings on one-third of the mill's land, with only 160 of the 240 flats in one building being reserved for them.

The Development Control Regulations (DCR) mandate that one-third of the land must be allocated for mill workers, yet only six out of the eleven buildings under construction are designated for them. The workers argued that the remaining 80 flats should also be reserved for them due to the long waiting list.

The High Court has posted the petition for hearing on February 5, 2025, and ordered a stay on the allotment of the 80 transit flats until the matter is resolved.
