Data reveals 75% disposed cases under RERA in three states

According to a report by property consultant Anarock, Uttar Pradesh, Maharashtra, and Haryana account for 75% of the total disposed cases under Real Estate Regulatory Authority (RERA) in India.

So far, 34 states and UTs have notified RERA rules. RERA is a federal law that applies to the entire country.

According to data from the Ministry of Housing and Urban Affairs (MoHUA), the respective courts have resolved a total of 65,539 cases. As of April 24, 2021, state authorities In Uttar Pradesh alone, nearly 40% of the cases (26,510 complaints) were resolved, followed by Haryana with 13,269 cases and Maharashtra with 9,265 cases.

RERA registrations for projects and real estate agents have been steadily increasing. Nearly 63,583 projects and 50,256 real estate agents had been registered as of April 24, 2021.

Around 40,155 projects and 29,208 real estate agents were registered during the col Read on App Period in 2019. Approximately 40,155 projects and 29,208 real estate agents were registered during the same period in 2019. Over the last two years, this represents a 58 % and 72 % increase, respectively.

Maharashtra continues to lead the way in project registrations, accounting for 45 % of all projects registered under RERA to date across 34 states/UTs. Gujarat is next, with a 13 % share, followed by Madhya Pradesh and Karnataka, each with about a 6% share, and Uttar Pradesh, with a 5% share.

Nagaland, in the North East, is still working on notifying its rules, while West Bengal enacted its own legislation, which was challenged by the MoHUA in the Supreme Court. However, in a significant development, the Supreme Court recently struck down the West Bengal Housing Industry Regulation Act, 2017 (WBHIRA) on the grounds that it overlaps with RERA, which was enacted by Parliament.

Since implementation, 30 states/UTs have established a Real Estate Regulatory Authority, with at least 5 of them being interim. RERA rules have also been notified in Jammu and Kashmir, Ladakh, Meghalaya, and Sikkim, but authorities have yet to be established.
