The Kerala High Court dismissed six of the appeals filed by the Delhi Land and Finance (DLF) over arbitration awards to returning money paid by six flat allottees with interest as flats, as promised, were allegedly not handed over. The prices of the apartments ranged from Rs 80 lakh to Rs 2.18 crore.
A division bench comprising justices CT Ravikumar and K Haripal considered appeals filed by DLF 亚博体育官网首页 Developers over the awards favouring allottees of the DLF Riverside project in Kochi at Chilavanoor.
The five flats were promised to be handed over in the year 2010, while one was to be delivered in 2011. The arbitrary claims got filed in 2015. An additional district judge later upheld awards passed by the arbitrator, and the DLF challenged these decisions before the High Court in the appeals.
The claimants booked the flats for the total prices of Rs 1.32 crore, including two car parking spaces; Rs 80.19 lakh; Rs 2.19 crore, including two car parking spaces; Rs 1.48 crore; Rs 2.18 crore, including two car parking spaces; and Rs 1.65 crore.
The arbitrator had given an award of Rs 2.32 crore for the flat of Rs 1.32 crore. An award of Rs 2.6 crore was ordered for the flat of Rs 1.48 crore. The flat of Rs 80.19 lakh got an award of Rs 1.35 crore, whereas the flat worth Rs 2.18 crore secured an award of Rs 3.82 crore. For the flat of Rs 1.65 crore, the award was Rs 2.87 crore, while For the flat of Rs 2.19 crore, the award was Rs 3.45 crore.
The division bench told the media that it does not find any reason to hold that the awards are infected with patent illegality as alleged. The court said that there is no illegality at all in the awards. The High Court said that the arbitrator did not award any compensation and ordered only a refund of the principal amount with interest.
