UP-RERA rejects registration application of Supertech projects

Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has refused the registration application of two offered Supertech projects under section-5 of RERA read with section 4(2)(B) and section-11(4)(B).
The decision has been taken since Supertech failed to complete a large number of its projects within the timeline submitted to RERA and has also failed in making compliance with a large number of orders passed by the authority on the complaints registered by the home buyers of the projects of the promoter company.
The rejected projects are Supertech Golf Country GH01- Phase-1A and Supertech Golf Country GH01- Phase-1B.
The authority had asked for a full compliance report of its orders and a credible action plan to complete its projects from the promoter.
R.K. Arora, chairman of Supertech, during the hearing, told the authority that the organisation was working to complete the projects and also to make compliance with the orders of the authority.
However, UP-RERA did not find written or oral answers of the promoter satisfying. It concluded that it is not suitable, and it shall not be in the home buyers' interest to allow registration of two new projects of the firm when it has not completed many projects already listed with RERA and has also defaulted in making compliance with a large number of orders given by the authority granting relief to resentful home buyers of the firm.
UP-RERA Chairman, Rajive Kumar, said that the promoter has not complied with the orders of the authority, and there has not been any discernible shift in the compliance status of the pending orders at the promoter's end. The promoter has also not given a credible action plan to complete its ongoing projects, which has resulted in many home buyers of the promoter being forced to come to the authority with complaints about relief. The promoter not only failed to give impulse to its projects, but it has also failed to comply with the orders of the authority, thereby further increasing the problems of home buyers.
The authority also concluded to give the promoter a second opportunity to re-apply for registration of these two projects after he substantially complies with the previous orders of the authority.
