Gurgaon Court Slams Police in Real Estate Fraud Case

A city court ordered the Gurgaon police commissioner to take action against a ""incompetent"" SHO whose ""incapacity"" to serve summonses on directors of real estate businesses accused of fraud suggested that ""delay tactics"" were being used to ""abuse the process of law."" 

The Punjab and Haryana high court ordered that the cheating and fraud case be filed against the developers of a housing project in 2014. 

The Gurgaon police had filed cancellation reports to dismiss the case twice, in May 2016 and March 2018, but the same court rejected them and began a trial against the developer. 

In 2022, the sessions court dismissed a challenge to the trial and asked police to summon the directors of precise realtors, Madeira Conbuild, Global Estate, and Ireo Grace Realtech, all of which were participating in the project, in May. 

Last month, police told the court that summons were never served by the Sushant Lok Police Station's SHO because the official delegated by him ""could not find the time"" to do so. 

The police report, according to Judicial Magistrate (First Class) Vikrant, was ""vague,"" and tasks cannot be fulfilled based on ""personal choice"" and ""comfort."" 

The judge stated that the cops had more than a year to serve the summons, which was ""sufficient"" time.

鈥淭he state had first filed the cancellation report and now the delay tactics are being adopted to abuse the process of law. Such kind of act and conduct needs to be dealt with strong hands.
