Brahma City鈥檚 licence to develop two sectors in Gurugram to be dropped

The Haryana Town and Country Planning (TCP) department has ordered the director to cancel the licence of Brahma City Private Limited to develop Sectors 60 to 65 in Gurugram.

Principal secretary of the town and country planning, A K Singh, said that the director of the town and country planning had been directed to proceed against the developer under the Act 1975, especially as contained in Sections 8 and 10.

Section 8 under the Haryana Development and Regulation of Urban Areas Act 1975 provides the licence cancellation and attachment of property, while Section 10 provides penal action against developers.

Singh passed these orders by disposing of the filed complaint, MVN Infrastructure Private Limited. The company argued that Brahma City Gurugram had violated the terms and conditions of the licence as they had sold the same plot many times.

To avoid obligation towards different entities, the company has instituted the proceedings under insolvency and bankruptcy code 2016 to introduce a third party and prepare further sales.

The plots were sold by the licensee through different companies. The company does not even deposit Electronic Draft Capture (EDC) amount to the government.

It was submitted that the Gurugram firm did not renew its licence. According to the alleged company, it approached Singh, the director of the town and country planning department did not consider the facts and did not take action against the developer.

In 2010, Brahma City Private Limited received the licence for developing 147 acres township in Sectors 60-65 in Gurugram. The developers were facing FIRs due to irregularities and cheating. A Central Bureau of Investigation team is also pending consideration to the developers.
