Guwahati HC releases notice to Chairperson of Assam RERA

The Guwahati High Court issued a notice to the Chairperson of Assam Real Estate Regulatory Authority following a PIL that the Assam Real Estate Regulatory Authority is not working following the law.
The court noted that the problem, which has been raised in this PIL, is that the Assam Real Estate Regulatory Authority, which is a statutory authority formed under the Real Estate (Regulation and Development) Act, 2016, is not working following the law.
Moreover, it has additionally been said that even a website has not been made by the Assam Real Estate Regulatory Authority, although it is a necessity under Section 34 (b), (c) and (d) of the Act.
According to the act, the works of the Authority comprise publishing and maintaining a website of records, for public viewing, of all real estate projects for which registration has been provided, to keep a database, on its website, for public viewing, and enter the names and photographs of promoters as defaulters covering the project details, registration for which has been canceled or have been penalised under this Act, with reasons therefor, for access to the general public, to maintain a database, on its website, for public viewing, and enter the names and photographs of real estate agents who have applied and listed under this Act, with such details as may be prescribed, comprising those whose registration has been rejected or canceled.
The court has registered the matter for February 3, 2022.
