The Haryana and Punjab High Court (HC) ruled that the Chandigarh Administration in the floor-wise sale of residential properties. However, it failed to discharge the onus of being the guardian of the city residents. The Bench of Justice, Tejinder Singh Dhindsa and Justice Vivek Puri, said that the Administration chose to stay smug that the floor-wise sale of residential properties was not permissible, while the residential floors were being advertised for sale. It further added that it had seen 24 advertisements for the floor-wise sale in Sunday Tribune. The Bench witnessed that the Union Territory Assistant Estate Officer deposed that the Administration would take steps to issue advertisements on local newspapers to warn the public against unverified advertisements on property sales. The Bench members had observed that 891 residential buildings were identified, where sale shares took place within a stipulated time. Many of the instances show that the shareholder was occupying a particular floor in the building. The issue was taken to HC after the residents' welfare association and other petitioners filed a petition against the Chandigarh Administration and other respondents through senior advocate Puneet Bali, B S Patwalia, Uday Agnihotri and Gauravjit Patwalia.
